Ownership of DataFrameworks® Software
Baydel North America, Inc. ("BNA") holds all right, title and interest in the BNA-DataFrameworks® software and all copies thereof, including all copyright and other intellectual property rights, except for certain third party rights described below. Except as specifically permitted by the BNA DataFrameworks® License Agreement, no part of the BNA DataFrameworks® software may be copied or reproduced without the prior specific written permission of BNA. The BNA DataFrameworks® software also contains components obtained from third parties or uses such components or such components are provided as part of or with (in stand alone form) the BNA-DataFrameworks® software or are wrapped in the BNA-DataFrameworks® software. These components remain the property of such third parties who reserve all rights to such components, subject only to the rights granted to users of the BNA DataFrameworks® agreement provided to the user by BNA. Such components may not be otherwise copied or altered in any way, and except as specifically noted, is provided "AS-IS" and without warranty of any kind.

Third Party Software Components
The BNA-DataFrameworks® software contains and is linked to MySQL® database software and certain drivers used in connection with the use or operation of that database software. MySQL AB® and its third party driver suppliers retain all right, title and interest in the MySQL® Software and all copies thereof, including the JDBC/Connect® and MyODBC® drivers.

The BNA-DataFrameworks® software contains software developed by The Apache Software Foundation® (http://www.apache.org). The Apache Software Foundation® retains the copyright to such software and reserves all rights not specifically granted to the user by the BNA DataFrameworks® License Agreement.

The BNA-DataFrameworks® software employs Easy Licenser® software in connection with the licensing registration, copyright protection, security and other similar functions. Any other use of the Easy Licenser® software is prohibited. Agilis Software LLC® is the sole owner of the copyright and other intellectual property rights with respect to the Easy Licenser® software and all copies thereof. The Easy Licenser®software includes software developed by The Apache Software Foundation® (http://www.apache.org). The Apache Software Foundation® retains the copyright to such software and reserves all rights not specifically granted to the user by the BNA DataFrameworks® License Agreement.

BNA's DataFrameworks® software contains/uses the JFree Chart application (www.jfree.org).  BNA hereby disclaims all copyright and other intellectual property interest in such software.  The use of the JFree Chart application is governed by  JFree under the terms of the GNU Lesser General Public License Agreement (http://www.jfree.org/lgpl.php).  Any other such use of the software is prohibited.

BNA's DataFrameworks® software contains/uses the JasperReports® software application (http://www.jaspersoft.com) owned by JasperSoft®, as an embedded operational reporting library solution. Any other use of the JasperReports® software is prohibited.  Jaspersoft® is the sole owner of the copyright and other intellectual property rights with respect to the JasperReports® software and all copies thereof

The BNA-DataFrameworks® software employs Install Anywhere® software in connection with the installation of the BNA DataFrameworks® software onto a user's computer or server. Any other use of the Install Anywhere® software is prohibited. Zero G® is the sole owner of the copyright and other intellectual property rights with respect to the Install Anywhere® software and all copies thereof.

The BNA-DataFrameworks® software is provided with unmodified and standalone forms of Sun Java Run Time® software and SGI Java 2 Run Time® software to enable a proper interface with the user's operating system. Any other use of the Sun Java Run Time® software or the SGI Java 2 Run Time® software provided with the BNA-DataFrameworks® is prohibited. Sun Microsystems, Inc®. is the sole owner of the copyright and other intellectual property rights to Sun Java Run Time® software, and Silicon Graphics, Inc®. is the sole owner of the copyright and other intellectual property rights to SGI Java 2 Run Time® software and all copies thereof.

BNA's DataFrameworks® software is provided with an unmodified and stand alone form of the Kunststoff Look and Feel Software (in both object code and source code versions) to enable the user to experience a more attractive look and feel of BNA's DataFrameworks® Software. Incors, Inc. (http://www.incors.org) is the sole owner of the Kunststoff Look and Feel Software. The user of BNA's DataFrameworks Software also has the rights with respect to the Kunststoff Look and Feel Software granted to the user or licensee under the GNU Lesser General Public License.

Trademarks
Baydel, BNA and DataFrameworks are trademarks of Baydel North America or Baydel, Ltd.

Apple® and Mac® and associated logos are registered trademarks of Apple Computer , Inc. Microsoft® and Windows® and associated logos are registered trademarks of Microsoft Corporation. SGI MIPS® is a registered trademark of Silicon Graphics, Inc. Sun®, Java® and Solaris® and associated logos are registered trademarks of Sun Microsystems, Inc. Red Hat® is a trademark of Red Hat, Inc. SPARC® is a registered trademark of SPARC International, Inc. Products bearing SPARC trademarks are based on architecture developed by Sun Microsystems, Inc.
